By using our web site or otherwise doing business with Seller (as defined below), you agree that all transactions shall be governed by these terms of service.

Any Sale shall be entered into between the Customer (“Purchaser”) and Internet Trailer Sales LLC and/or Croft Automotive and Trailer Inc (St. Louis, MO). (For sales where delivery is made in Libertyville, Illinois, Rouse’s Hitch N Tow LL shall be considered the Seller herein) (collectively and individually, whichever may be applicable, hereinafter the “Seller”). Purchaser agrees to purchase, and Seller agrees to sell the trailer(s) or parts described in the written confirmation of your order. This written confirmation (“Confirmation”) at Seller’s option, may be sent by email, facsimile transmission or by postal or other carrier such as overnight delivery couriers. The trailer or (and/or parts order if applicable) shall be equipped with the options and specifications set out in the Confirmation. For dealer registration purposes, for all sales by Croft, this sale contract and the actual sale contract shall be deemed to be consummated in St. Louis County Missouri and the terms of this agreement shall be governed by Missouri law regardless of any conflicts of law considerations.  

Deposit

All trailer deposits are non-refundable. Once an order is placed, by us, on your behalf, we are committed to Haulmark (or another manufacturer if applicable) for the purchase of that trailer. When you cancel an order of a trailer, the factory may require us to purchase that trailer and arrange for delivery to one of our stores in St. Louis or Chicago . To protect us from freight and other expenses, deposits are non refundable after the trailer order has been placed with the factory. As the amount of our damages as a result of a cancelled order are difficult to estimate, the deposit shall be considered liquidated damages to us.  While this is our written legal policy, we will, at our sole discretion, entertain a request for cancellation and a refund under extraordinary circumstances provided we can cancel our order with our manufacturer or otherwise sell the trailer. This provides legal protection for us. At the same time, we are not hard liners and want to sell you a trailer and keep you satisfied.

Information We Collect

When we need to collect personally identifiable information from you to provide you with a Login Name we will ask you to voluntarily supply us with the information we need. We will use your e-mail address to send a confirmation and, if necessary, might use the other information to contact you for help to process your quote request. We will also use your e-mail address to notify you about special offers and promotions as described in the E-Mail section of this Statement, but you can opt out of e-mails at any time.

Delivery

Delivery for pickup is at the location indicated in the Confirmation. If no location is specified, delivery is at the Haulmark factory in Bristol Indiana for Haulmark trailers or the plant of our designation for other manufacturers. We attempt to deliver all trailers by the date specified. We place the order promptly with the factory, and generally the factory is accurate with delivery times. Sometimes though, the factory may encounter a production delay for a variety of reasons. If the delivery date is absolutely essential to you, please discuss this with your salesman upon ordering, and we will make all reasonable efforts to monitor your trailer manufacture, and to also inform the factory of your production delivery timeframe, to ensure they know of these circumstances. We are one of the largest Haulmark dealerships in the country and have close relationships with each factory. This has helped us to expedite delivery on some occasions. While we do not control the manufacture process, we are confident that our customers receive prompt attention from Haulmark. Volume helps.

Parts Return

Defective or broken parts may be returned within 21 days of receipt for a full refund less shipping charges.  Restocking fees will be charged if your order is not returned in its original box, is missing packing material, manuals or any accessories or if the part is not defective or broken.  Free shipping (and reduced shipping) promos do not apply to return/exchange shipping on freighted items (50 pounds or more).  No returns or exchanges on food products. Contact us within 24 hours of receiving your merchandise if it has been damaged in transit or defective. We will gladly send a replacement free. The return policy applies only to trailer parts and not trailers. Trailer defects and other trailer issues are covered by the manufacturer’s warranty.

Warranties Seller is dealer for products manufactured by other companies. We sell trailers and trailer parts manufactured by the leading manufacturers in the trailer and trailer parts industry, each of whom offers some of the best and most complete warranties in the industry. However the warranties are those of the manufacturer only and those terms are covered by that warranty. Other than the terms of the manufacturer’s warranty, products are sold WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES SHALL SELLER BE LIABLE FOR CONSEQUENTIAL INCIDENTAL OR OTHER DAMAGES AND SELLER’S LIABILITY SHALL BE LIMITED TO THE LESSER OF THE COST OF REPAIR OF ANY DEFECT/DISCREPANCY IN ORDER OR THE COST OF THE ITEM(S) NOT MANUFACTURED OR WORKING IN ACCORDANCE WITH THE SPECIFICATIONS AND TERMS OF THE ORDER.

Miscellaneous

In the unlikely event of a dispute, Purchaser and Seller agree to binding simple arbitration with the American Arbitration Association in St. Louis County Missouri. The arbitration results shall be enforceable in St. Louis County Circuit Court. All change orders to your trailer must be confirmed by us in writing. Your trailer will be equipped with the options in the written contract and Haulmark specifications. This protects us both from any confusion. That’s it.

Consistent with the 15 USC 1666f all prices quoted include a cash payment discount of 2.5%.”
